State govt violated rules while promoting officers to Chief Secretary rank

 

Patna, (Bihar Times): The Nitish Kumar government has violated Rule 9 (7) of IAS (Pay) Rules in promoting six IAS officers to the rank of chief secretary in addition to the existing five in the same rank.

Reports said that the Union government has termed this act as a clear cut violation of the rules. The stand became clear when a resident of Patna, C M Kumar, filed an application with the department of personnel and training under Right to Information Act. He wanted to know whether the rules where followed or not while promoting so many officers.

They were promoted on December 20, 2008. Till that date the state could only have three cadre and three ex-cadre officers of the rank of the chief secretary. However, the cadre and ex-cafre posts were increased to four by the Centre with the effect from December 30, 2008. But even this increase by one was not enough to justify the presence of 11 officers in the rank of the chief secretary against eight––(four cadre and four ex-cadre) in that rank.

Reports said that the Union government said its approval was not taken by the state government before promoting so many officers to the rank of the chief secretary.

According to the IAS (Pay) Rules the prior approval of the Union government is a must if the upper limit of number of officers in the pay-scale of Rs 80,000 given to the chief secretary rank is crossed.

It needs to be mentioned that Kumar had filed a similar application with the Public Information Officer of the Personnel And Administrative Reforms department of the Bihar government, but failed to get the required information withint the stipulated time.

Kumar was quoted in the Times of India as saying “instead of waiting for the state government’s reply I have decided to seek legal opinion on the basis of information provided by the Centre before taking the next step.”
