Yadav's father C.N. Prasad underwent a kidney transplant Sep 15 at Sir Ganga Ram Hospital here.
"What will he do there. His father is in good care," said an apex court bench of Justice Markandey Katju and Justice T.S. Thakur, rejecting his plea for bail.
Sarkar, who represented Purnia assembly constituency, was gunned down at Subhash Nagar area of Purnia June 14, 1998.
Four-time MP Yadav was arrested in 1999 and convicted for the murder and sentenced to life imprisonment Feb 14, 2008.
When counsel Rakesh Kumar Singh, appearing for the petitioner, told the court that the presence of the petitioner would boost the will power of his father to fight his ailment, Justice Thakur said: "Ganga Ram hospital has a good nursing care."
Meanwhile, the apex court has asked the Patna High court to expeditiously deal with Yadav's plea challenging his conviction and sentencing by the trial court in the Sarkar murder case.
