K K Pathak shifted, may get court punishment

Patna,(BiharTimes): The state government on Wednesday night transferred K K Pathak, from the post of secretary, human resource development department, to the managing director of Bihar State Electronic Development Corporation (Beltron), following his repeated absence from the proceedings of a contempt case in the Patna High Court.

Pathak, who has not appeared on at least half a dozen occasions before the court, is liable to face legal action. A source in the court said he will not escape punishment in the contempt proceedings even though being transferred to another department.

He can be awarded imprisonment up to six months. The high court had initiated contempt proceedings against Pathak on July 30 and had directed him to be present in the court on the next date of hearing, which was August 18.

Pathak was summoned five more times, on August 20,24,25,26 and September 1, after that. He did not turn up for any of the hearing. On August 26, the court gave Pathak another opportunity to appear before it and asked additional advocate- general Lalit Kishore to convince him to come to the court.

Earlier, the court had initiated suo motu contempt proceedings against Pathak for ordering the concerned authorities to make recoveries of excess payment from teachers of the various universities despite the court’s earlier directive that the teachers would not be forced in this regard. The court was hearing petitions filed by three Patna University teachers—Vinay Kanth, Dharmsheela Prasad and P K Poddar.
