.Patna, Aug 9 (IANS) A Central Bureau of Investigation (CBI) court here Tuesday ordered that Rupam Pathak, a school teacher accused of stabbing a Bharatiya Janata Party (BJP) legislator to death in January, be booked for murder instead of the lesser charge of culpable homicide.
The court was hearing a petition filed by Sudip Kesri, nephew of the slain legislator Raj Kishore Kesri.

The court had in June framed charges of culpable homicide not amounting to murder against Pathak. But Sudip had challenged the CBI chargesheet, saying that Pathak should have been charged for murder.
Pathak's lawyer Dinesh Kumar said that they will approach a higher court to challenge the decision.
Pathak is lodged in Beur jail in Patna following the killing of BJP legislator Raj Kishore Kesri.
Pathak alleged that Kesri, legislator from Purnia constituency, raped her for over three years -- a charge the BJP refuted.
According to police, Rupam Pathak, in her mid-40s, went to Kesri's home in Purnia and stabbed him to death in the presence of a number of people.
Chief Minister Nitish Kumar had ordered a CBI probe into the murder.
In April, the CBI court in Patna granted bail to Navlesh Pathak, editor of an English weekly and co-accused in the murder. The court granted bail to Navlesh after the CBI failed to file a chargesheet against him within the stipulated 90 days.
