Patna,(BiharTimes): The January 4 morning murder of the sitting BJP MLA from Purnea, Raj Kishore Kesri, at his home and the subsequent attempt to lynch the attacker, Rupam Pathak, is a pointer to the fact that somewhere something is grievously wrong in the case. Not surprisingly, the incident took place after a spate of kidnapping-cum-murder in the state. |
Though immediately after the murder the deputy chief minister Sushil Kumar Modi said that the woman had been trying to blackmail Kesri the truth is that cases like these need to be properly probed before jumping to any conclusion. Now that the 40-year old woman, who had been accusing (now late) MLA and his men of repeatedly raping her has taken such an extreme step one can say with certainty that everything is not hunky-dory as is being made out by the BJP.
Though the women’s rights organizations have not open up their mouths yet many of them are, of the record, saying that since Rupam had taken such an extreme step one can not dismiss the case out of hand by just stating that she wanted to blackmail Kesri. After all Sushil Modi and other state BJP leaders stood behind Kesri in May last too. He also got ticket for the Assembly for the fourth time in succession.
Whatever be Modi’s view the chief minister Nitish Kumar during the last year Vishwas Yatra refused to share dais with Raj Kishore Kesri. Some senior officials came to the dais and politely asked him to leave the place. Only then the chief minister came. Yet even there the deputy chief minister publicly defended Kesri fully knowing that in 2008 another woman levelled similar charge against the same MLA.
Legally nobody is defending the action taken by Rupam but the general view is that she took the step because she did not get justice. True there is some sympathy for Kesri in the political circle, yet there is no dearth of sympathy for Rupam too. In this age of internet journalism websites are flooded with mails applauding what she did. Some even went on to suggest that she should be given national bravery award.
There is hardly any taker of the police version that she backtracked before the magistrate last year and that her husband and other family members did not pursue the charge of rape levelled last year.
Though the media last year underplayed the news several BJP leaders then saw a big political conspiracy in this accusation. The extreme action taken by Rupam after the big victory of NDA and Kesri himself suggests that perhaps there was no political motive behind it. Rupam, after all is not a political activist, but a woman, who used to run a school. After killing the MLA she reportedly said that she had accomplished her objective and that she is now prepared to be hanged for the crime she had committed.

It does not behove the deputy chief minister Sushil Kumar Modi to call Rupam Pathak a blackmailer when the investigation is going on.
Last year too when the issue came up for the first time he said it was an attempt to blackmail the MLA. If this is not influencing the investigation than what else is?
As a woman I fully understand the predicament of a woman. Won’t she backtrack before the magistrate when the deputy chief minister of the state call her blackmailer. This time again he and now even the officials are raising suspicion over her character. This is simply obnoxious and deserves condemnation.
If she was a blackmailer than why did the chief minister Nitish Kumar refused to share dais with Raj Kishore Kesri in Purnea after she levelled the charge. And what about the other woman who levelled similar charge in 2008 against the late MLA.
Now that the woman is prepared to be hanged for the crime she had committed how can you call her blackmailer? What was the motive of this blackmailer? It is upto the deputy chief minister to explain this fact.

The first and foremost question which comes in mind is: There must have been some compelling reason for Mrs. Rupam Pathak to take such an extreme step. Not just that, after committing the murder she did not try to escape. We don't know who is right and who is wrong but this is something which even very influential person would not dare to do so easily with his/her enemy. And in case of Rupam Pathak like common man, middle class person, a simple life is everything. And we know that she risked her life too by killing Kesari. So definitely Sushil kumar Modi's 100 certificates of character to the MLA would not suffice. Here is something really fishy and culprit should be booked. Be it Modi or be it all those policeman who sat on the complaint by Rupam Pathak.
Nitish Kumar did the right job by issuing immediate enquiry into this episode. But Mr. Kumar please tell me how much neutral and justice this enquiry would be where the same policemen will be doing the job of enquiry who are actually reason for the inaction and injustice done in this entire episode. Had police behaved in citizen friendly manner and would have pursued its duty, this case would not have happened. In this entire episode, actually , the real culprit is not Rupam or MLA but your police system, the law makers who have become agents of influential and have no character to work strongly. There is no proof that police acted on Rupam's complaint. Rupan might have been wrong or blackmailing the MLA, but is there any substantial proof of that and enquiry done credibly?
Mr. Nitish Kumar garnered too much praise, a win and public vote which hardly some could dream to have. But if he does not make his police and administration system overhauled, his government would meet the same fate which Lalu Yadav did. Junta of Bihar is not fool. Time is the witness, those who have fallen in the eyes of Bihari junta have never again come into the power. Poeple of India may forget and re-elect, but memory of Bihari junta is different. They don't forget and they don't forgive. They only amalgamate you and your political career in the soil: Take clue from Jagannath Mishra, Lalu Yadav, Bhagwat Jha Azad, Ram Vilas Paswan...all finished forever! So get up Mr. Nitish Kumar. You are not here due to BJP or Sushil Modi or some criminal politician or broker kind police and administration officer but due to public of Bihar. Overhaul your administration and public dealing before its too late. Take some really strong decisions on administration whose intention should be public service not media hype. Otherwise like Lalu, your and BJP's obituary would be written very shortly. And please never forget the story of the King and his idiot friend monkey who chopped his nose.

Something is definitely fishy here.If she filed a case against the MLA and later backtracked,why didn’t the MLA file a counter case against her for trying to malign his reputation.After all it was such a serious charge for a public representative.Why was she not asked at that time the reason for withdrawing the case,it was not something she could have done by mistake!There are lapses at the administrative level and these people go scot-free because most cases don’t come to limelight.Its only these embarrassing moments,which are fortunately(for the officials)rare and tip of the iceberg,that the true state of affairs of the rich and powerful people is depicted.I don’t commend the act of this possible victim teacher but at the same time I don't have any sympathy, whatsoever,for the slain MLA.Its has raised several issues for the Criminal Justice System for the state or for that matter for the country which needs to be pondered.

There may be a host of reasons leading to the MLA's murder. The MLA might have been a patron of the lady or the lady might have been a frustrated, dejected person unstable in her mind. Only a thorough inquiry will reveal what happened and we should refrain from pre-judging the issue.
One thing, however, appears clear is that the lady had close access to the murdered politician. Else, how could she go so close as to stab him in the presence of his security guards. Strict codes of behavior suggest that the lady should have been overpowered and handed over to the police. No law or authority gave the mob or the security personnel to physically punish the lady. Only the court could do that. But, unfortunately in Bihar, the justice administered by a mob trumps everything else.
Lawlessness (including kidnapping) is an old problem in Bihar and we should all respect the rule of law. The Nitish administration promises to deliver the rule of law fast. This is yet another test for the renewed triumphant government. In the absence the rule of law, lawlessness will grow even more rapidly.

Classic over-zealous explanation particularly when it involves some woman accusing someone , seems to be at work here. Noone knows the truth so speculative line since woman has taken drastic step so she must have a point d should be cheked. Otherwise this is open invitation for killing people and then hiding behind the logic that I took this step so I must have some legitimate reason.
So far only truth is that the woman is a murderer and MLA is victim of that murder rest of the accusations remain an accusation.
Many questions will be asked. I always question the motive when this repeated rape charge comes. Why should an MLA pick a noname teahcer for repated rape. Why the alleged rape victim had epiphany after years of the incident, why didn;t she report it earlier. Was she seekign some favor in return of sexual favor bestowed and hence remain silent till the quid-pro-quo didn't matetrialize.
It's note worthy that she has accused even her own father-in-law of rape in past.
All said and done so far only truth is that she is a murderer rest of the acusations remain mere accusations with many gaping holes in her story.
I know mass hysteria is usually in support of weaker in any disupte but since the day I got a rape charge slapped on me. Fortunately on alleged rape date I was not in india and had to just send the details of travel and saved myself otherwise I would have been termed a bonafide rapist by ppl I have property dispute with.
Bottomline nobody knows any truth so far beyond the fact that woman has murdered an elected legislator in cold blood. So hold your horses guys. Woman will throw charges and murder victim will throw counter-charges don't attach much value to any of these till things become clear in court.
And no Sushil Modi is not judge once the FIR gets registered judcourt albeit corrupt by and large works in India
Only truth is that a murder has happened and guilty has been caught red-handed.

Ruling coalition should introspect about people whom they have given tickets to contest elections. Situation leading to take such a strong step must be very alarming. Investigation should focus on this. Last month an woman M L A was brutally beaten by her infamous husband. People of Bihar have not shown the maturity what they have shown during Parliament Election. All having criminal background were defeated during Parliament Election. During Assembly Election this has not happened.
Perhaps even Shri Nitish Kumar was more guided by winning ability of candidates rather than their character. Perhaps he got panicked by the result of 18 Assembly By Election . He must be repenting for not denying ticket to criminal elements . We hope politicians will not come to the rescue/ defense of

The way immediately after the murder, the Dy C.M Sushil Kumar Modi said that " the woman had been trying to blackmail Raj Kesri "- I strongly condemn his attitude and intention. Its seems Modi knows much more details regarding the whole episode. His statement has left many questions.
1. will Rupam Pathak will get the justice?
2. Can we expect free and honest trial in this case ? when the Dy CM is batting on behalf of rapist legislator.
3. If CM, Dy CM will attend the funeral of the legislator, will our system remain unbiased in the prob / police investigation?
4. is system really concerned for common man ( victim Rupam Pathak ) ?

I don,t know the authenticity of the above article but an independent (honest) inquiry must be conducted and truth should come forward thorough investigation to know the circumstances which led to the killing.

Modi speak with the vested interests. He started to play football with Bihari. Better he should learn Political ethics 1st and the start to teach others.
I have more interest in his administrative abilities. What he did to investigate the case on administrative level which is decanted under him as on today.

The accident is very shameful. Why do the public take laws in hands? It is because they don’t get justice.
This kind of action by public discloses that people are deprived of the justice at the hands of influential people and the government are silent spectator. Transparency in the police force and the court needs to be ensured to ensure stoppage of such kind of accident. Now it is the duty of the government to bring fact to the public by having an unbiased inquiry. The wrong-doers take generally 3 steps to hide their crimes (1) they warn victim of severe consequences if they go to the police to report the matter. (2) if they fail here they try to influence the police forces. (3) if they are unsuccessful here they try to influence the court. How and why these government machineries obey the wrong-doers is not hidden. Secondary, the political party these wrong-doers belong to always tries to protect them for the vested interest of the party.
The Nitish government has to go long way to clean the system and to bring the lucidity there. We do hope he can do it as he is determined to fight corruption at every expense.

This matter is of very serious nature and needs to be thoroughly probed. It is to be noted that a women will not allege just an MLA for any personal gain compromising her modesty and self-respect. I urge CM Nitish Kumar to arrange a proper investigation and protect this lady. The overall idea is "JUSTICE MUST PREVAIL" to both side.
