Patna Residents lodge case against builders for flouting PMC rules

Patna,(BiharTimes): It is now the citizens’ turn to take up the cudgel against both the builder mafia and the Patna Municipal Corporation (PMC).
Residents of Indirapuri Co-operative Housing Society in Ashiyananagar area on Wednesday lodged an FIR against two builders for allegedly starting construction work in two apartments in their locality as they were flouting the Bihar Municipal Act.


The case was lodged in the Shastri Nagar police station.They alleged that the PMC wrongly approved the projects of Vastu Vihar and A-One Galaxy. While Vastu Vihar is being constructed on two cottahs of land in the Society the area of A-One Galaxy is three cottahs


According to the Section 19.4 of Modified Building Bylaws of Bihar Municipal Act the minimum width of a plot for assembly occupancies (apartments or hotels) should be 25 metre. They should be in front of streets not less than 15 metre wide. In case of newly developed areas, the width of the plot for assembly occupancies should not be less than 30 metre and should be in front of streets not less than 27 metre wide.

But, according to R P Sinha, Retired Professor, Patna Veterinary College, who is also a complainant, in case of Vastu Vihar, the width of the plot is just 12.5 metre. The width of the plot of A-One Galaxy is 22 metre.
Also, the street along which the apartments are being constructed is only 6.2 metre wide, way too less than the prescribed limit of 15 metre. The height will also cross 55ft, which is too high for such a narrow street.
What is strange is that notwithstanding these limitations, the building plans were approved by PMC.
Residents also complained that apartments cannot be constructed in a co-operative society, wherein plots are allotted exclusively for residential purpose.

In case of Vastu Vihar apartment, a member himself is getting the building constructed by a builder. The A-One Galaxy is being built on a plot sold off by a co-operative member without taking the permission from the co-operative society committee. All members of the society are dead against these projects as they are illegal.
But the builders counter the charge by stating that they have got their projects approved by PMC. They also say that several apartments are being constructed in the city on small plots and narrow roads.
