Another PIL filed in High Court on BIADA allotments

Patna,(BiharTimes): A day after a former RJD MLA moved the Patna High Court seeking a CBI probe into allotment of lands to the close relatives of ministers, ruling party leaders and bureaucrats by Bihar Industrial Area Development Authority (BIADA) another Public Interest Litigation (PIL) was filed by former Samata Party leader and ex-MLC P K Sinha and social activist Sarwar Khan Warsi.



The PIL filed on Friday prayed to the High Court to cancel the allotments of land plots and nullify BIADA (Financial, Technical) Regulation, 2007 a rule that allowed it to allot land plots without inviting tenders.
Dinu Kumar, their counsel, said the PIL has sought a direction to the BIADA to cancel the allotments of land made after December 27, 2007 as they were made without inviting tenders. It has also sought an inquiry into all such allotments by an independent agency such as the CBI as the allotments caused huge revenue losses to the state exchequer.

The High Court’s intervention has been sought to investigate the people who were responsible for bringing in the Regulation in 2007 through which it was provided that tender was not required for allotment of land plots.

According to the counsel the PIL has quoted a Supreme Court verdict in a case in which it ordered that the allotment of land must be in conformity with the Right to Equal Opportunity as given to every citizen by the Constitution.
