Universities’ Bills: Bihar Speaker over-rules Governor

 

Patna,(BiharTimes): Bihar Speaker Uday Narayan Chaudhary said on Monday that his decision on the Bihar State University (Amendment) Bill 2010 and Patna University (Amendment) Bill 2010 is legal and final.
Over-ruling Bihar Governor Devanand Konwar’s decision to withhold his assent to the Bills he said on Monday that the two Bills were introduced in the House after obtaining the opinion of the state Law Secretary. Under Article 207 (1) (3) of the Constitution, the Governor’s endorsement to the Bills was ‘not necessary’.

The Bills were then introduced and adopted by both the Houses of the state legislature which was forwarded to the Governor for his assent by the state Assembly secretariat. But, the Governor’s secretariat, later, returned the copies of the Bills to the finance department with a copy of the same to the Assembly secretariat stating that they are Money Bills. But the Speaker said that they are normal Bills and not Money Bills. With this stand of Speaker it is now virtually mandatory for the Governor to give his assent.

Chaudhary said that Article 199 of the Constitution provides that in case any dispute arises on the issue of Financial Bill, the Speaker's decision would be final.

NDA members Amrendra Pratap Singh, Dr Achyutanand, Binod Narayan Jha, Rameshwar Paswan, Usha Sinha and Izhar Ahmed raised the issue of Konwar withholding the two Bills. The amendments seek to curtail certain sweeping powers of Governor-cum-Chancellor in running universities. The Bills have been passed on March 26, 2010 but it remained withheld in the Governor’s secretariat since then.

However, legal experts are concerned over the government move to curtail the autonomy of the Universities. Now the Vice Chancellor will have to function under the officials of the state government, they said.
