Patna HC dismisses PIL for CBI probe into DC Bills

Patna,(BiharTimes): A division bench comprising Justice P C Verma and Justice A K Trivedi of the Patna High Court on Monday dismissed a PIL seeking direction for a CBI probe into the alleged misappropriation of Rs 11,854 crore in various development schemes of the Bihar government.

The Court passed the order reserved on July 11 after hearing the PIL filed by Arvind Kumar Sharma and others.

The bench said that from perusal of the concerned rules, it is apparent that the Public Account Committee (PAC) has all the powers to come to right and correct the decision and submit the report to the state Assembly.

On its part the Bihar government had taken a stand that there was no misappropriation of funds and the reconciliation of AC Bills through Detailed Contingent (DC) Bills was a continuous process and it existed in other states as well.

The state government had said the matter related to CAG report on non-reconciliation of AC/DC Bills was pending consideration of the PAC of the state Assembly and the High Court did not have any jurisdiction to interfere.

The bench in its order observed that since the PAC was seized of with the matter and the report was to be submitted to the House and thus, an inquiry by CBI was not warranted. The Court had earlier directed the government and the petitioner to file their written submission in this regard.
