Patna,(BiharTimes): A division bench comprising Justice T Meena Kumari and Justice Gopal Prasad of the Patna high court on Tuesday refused to interfere in the alleged irregularities in allotment of land by the Bihar Industrial Area Development Authority (BIADA) and asked the petitioners to approach the state government with their plea. It also directed the state government to take appropriate action in this regard. |
The court passed the order on a petition filed by former MLC P K Sinha and others. Sinha, one of the founder members of Janata Dal (United) and now a party rebel, in his petition, alleged that plots of land were allotted to the relatives of ministers, legislators and bureaucrats at throwaway prices.
The irregularities were unearthed by a couple of television channels last year and created a storm in the political circle. The opposition parties disrupted proceedings of the monsoon session of the state Assembly, demanding a CBI probe into the matter.
The government ordered an inquiry by the chief secretary who gave clean chit to the procedure adopted in allotment of land.
Sinha and others then moved the Patna high court with their petition alleging that the plots of land were allotted by BIADA on the first-come-first-served basis in violation of the established norm of inviting tenders. This caused huge loss to the state exchequer, the petition alleged.
Interestingly, the Supreme Court, while delivering its judgement in the 2G Spectrum case recently had rejected the first come first served method.
