A bench of Justice R.M. Lodha and Justice Anil R. Dave issued notice after counsel D. Vaidyanandan told the court that police had done just nothing to trace Navaruna Chakravorty following her kidnapping on the intervening night of Sep 18-19, 2012.

Notice is returnable in six weeks.

According to police, the three kidnappers broke the three rods of the window to enter the girl's room, rendered her unconscious and folded her in a bed-sheet to carry her away.

Police have so far rounded up five people, including Sanjay Chakravorty who is locked in a land dispute with Navaruna's father Atulay Chakravorty.

The PIL petition, moved by Delhi University law faculty students, hailing from Muzaffarpur, said Bihar Police has played a mischief by clubbing the kidnapping of Navaruna with that of elopement. Navaruna is a class 7 student of St. Xaviers school.

PIL petitioners Abhishek Ranjan Kumar, Aaditya Kumar Rahul Maurya and Rajkumar Tyagi said it was 110 days since Navaruna was kidnapped but she has not been recovered.

The petition said that without producing an iota of evidence, police have alleged that it was a case of elopement and "may also be a case of property dispute".

The PIL petitioners contended that in the wake of their protests, the case's investigating officer, Sub-Inspector Amit Kumar, came to Delhi and threatened them to desist from their protest or all of them would be arrested.

They said that they have recorded all these threats by the investigating officer and the transcript of the same along with CD has been annexed with the PIL petition.

The petition said that the parents of the kidnapped girl have approached everyone in the corridors of power but without any result.

The girl's father met the state police chief who initially assured that the girl would be brought back safe but later shouted at him, the PIL said.

Navaruna's elder sister Navarupa, also studying in Delhi University, had written to Prime Minister Manmohan Singh seeking his intervention.
