Patna, (Bihar Times): The
Patna high court on Tuesday issued contempt notice to the managing director
of Bihar Industrial Area Development Authority (BIADA), for imposing cost
(legal expenses) on industrial units for approaching different courts of justice
to redress their grievances against the Authority. On
October 9 BAIDA issued an order stating that since the industrial units are
filing a number of cases against it leading to unnecessary expense Rs 5,000 each
be recovered from those approaching consumer forums and district courts and
Rs 15,000 from those filing cases in the high court as the legal expenses. The
court observed that prima facie it is is a gross contempt of court. While hearing
petitions challenging BIADA move to auction plots already allotted to the petitioners
for seting up industries in Pataliputra industrial area Justic Navniti Prasad
Singh directed that notice be issued to the managing director asking him
why should he not be proceeded against and punished for his action, which was
detrimental to the constitutional set up. The court fix November 26 as the
to hear this matter. According
to the court MDs action is a deliberate measure to prevent people from
seeking judicial review, which is the basic feature of the Constitution.
